Sandusky Victim to Sue Penn State
Fitzgerald Cecilio

HOME > SPORTS

Philadelphia, PA

Attorneys for sought-after "Victim 2" of convicted child abuser Jerry Sandusky emerged and declared that their client is determined to sue Penn State for damages.

The second victim was the one being sexually abused by Sandusky in the university's locker room when Penn State coach Mike McQueary chanced upon them in 2001.

He was a virtual unknown and did not testify or appeared during the trial of Sandusky, who was found guilty of 45 charges of child molestation.

"Jerry Sandusky's abuse of victim 2 and other children is a direct result of a conspiracy to conceal Sandusky's conduct and the decisions by top Penn State officials that facilitated and enabled his access to victims," lawyers for Victim 2 said in a statement.

"We intend to file a civil lawsuit against Penn State University and others and to hold them accountable for the egregious and reckless conduct that facilitated the horrific abuse our client suffered," the lawyers added.

The lawyers said their client "has to live the rest of his life not only dealing with the effects of Sandusky's childhood sexual abuse, but also with the knowledge that many powerful adults, including those at the highest levels of Penn State, put their own interests and the interests of a child predator above their legal obligations to protect him".

The lawyers also presented voicemails that Sandusky allegedly left the second victim less than two months before his arrest, expressing his love for the young man. Sandusky even ended one message with "I love you".

The lawyers provided no other details, including the identity of the second victim and the reason why he did not testify during Sandusky's trial.

McQueary testified during the trial that he witnessed Sandusky, then the assistant football coach, sexually abusing the victim in 2001 in the Penn State shower room.

In his testimony, he then informed coach Joe Paterno and other university officials about the incident but none of them reported to authorities.

Former FBI director Louis Freeh later discovered that Paterno and other university officials decided to conceal the incident to shield the football team and the school from bad publicity.

Amid the release of Sandusky's voice messages to second victim over the media and the Internet, Dottie Sandusky has pledged love for Jerry, her husband of more than 40 years.

"I love my husband," Dottie said. "He's not who they say he is".

Penn State president Rodney Erickson tells CBS News' Bob Schieffer the university is "adequately covered" against lawsuits that may come up after former assistant football coach Jerry Sandusky was found guilty of using his position to sexually abuse underage boys
